Ninth Circuit Holds Municipally Zoned Senior Housing Permissible under the ‘Senior Exemption’ to the Fair Housing Amendments and Housing for Older Persons Acts

On February 17, 2012, the Ninth Circuit Court of Appeals held that municipally zoned senior housing could qualify for the “senior exemption” under the Fair Housing Amendments Act (FHAA), which allows communities that provide housing for older persons to exclude families with children.
