District Court Grants Motion to Dismiss Claim Involving Colorado River Water against Development of Solar Energy Plant for Lack of Standing
California Unions for Reliable Energy v. U.S. Department of the Interior, ___F.Supp.2d___
The U.S. Bureau of Land Management (BLM) and Department of the Interior (DOI) approved the construction of a 250-megawatt solar electric generation plant by Genesis Solar, LLC (Genesis) on public desert land in California owned by the BLM. California Unions for Reliable Energy (CURE), a coalition of labor unions whose members construct, operate and maintain power plants throughout California, and two individuals who depend on the Colorado River as their water source, sued BLM and DOI requesting an order to enjoin the commencement of construction of the solar plant because they claimed the plant’s use of water coming exclusively from the Colorado River would endanger their water supply.
