Fifth District Upholds Adoption of Several Development Impact Fees—Finds Fees Survive Scrutiny under Mitigation Fee Act and Quimby Act

The Fifth District Court of Appeal recently upheld a number of development impact fees adopted by the City of Lemoore. These fees included a community/ recreation facility impact fee, park land impact fee, police impact fee, municipal facilities impact fee, fire protection impact fee for new fire protection facilities, and refuse vehicle and container impact fee.
