This month’s News from the West involves legislation, cases, and opinions from California, Washington, and Colorado; all involving different types of attempts to regulate water usage in the face of scarce supplies and overuse. First, the California Legislature passed a comprehensive water package of bills aimed at helping solve the state’s recurring water shortages. Next, the Attorney General for the State of Washington issued an opinion supporting regulation of any new permit-exempt groundwater wells. Finally, the Court of Appeals of Colorado sided with a water district in its regulation of the amount of groundwater that could be withdrawn in permitted wells.
