In this month’s water news from the West, the Montana Supreme Court allowed the expansion of a water district’s boundaries over the objections of a coappropriator from the same water basin, the Colorado Supreme Court declared that the use of a fixed water year was proper in determining a user’s allocation amounts, and a California appellate court concluded that they could not determine whether reliance on a community plan environmental impact report (EIR) that had an insufficient water supply analysis was proper because petitioners had failed to exhaust their administrative remedies.
