First District Upholds Severable Portions of Oakland’s ‘Just Cause’ Eviction Ordinance
Rental Housing Association of Northern Alameda County v. City of Oakland, ___Cal.App.4th___
A group of landlords in the City of Oakland (Oakland) sought a writ of mandate to prohibit the enforcement of an ordinance that was adopted as initiative “Measure EE” at the general election in November 2002 entitled “Oakland Just Cause for Eviction Ordinance.” The trial court concluded that the invalid portions of Measure EE were severable from the valid portions of the ordinance and that those remainder provisions may be enforced. The Court of Appeal affirmed.
