First District Court Affirms Invalidity of Bayview Hunters Point Redevelopment Plan Referendum
Defend Bayview Hunters Point Comm. v. City and County of San Francisco, ___Cal.App.4th___
The First District Court of Appeal held that the clerk of the San Francisco Board of Supervisors had a ministerial duty to reject a referendum petition on an ordinance for failing to include a copy of the document that the ordinance adopted and enacted into law. The court reasoned that the document at issue, the Bayview Hunters Point Redevelopment Plan was the source of the critical text enacted into law by the ordinance, thus making it “essential information” that had to be attached to the petition.
