District Court Grants Taxicab Association Injunction against Implementation of State Fuel Economy Regulation
Metropolitan Taxicab Board of Trade v. City of New York, ___F.Supp.2d___
The Metropolitan Taxicab Board of Trade (MTBOT), a trade association made up of taxi fleets in New York City, sued to enjoin the City of New York from implementing a regulation which required all new taxicabs to have a minimum fuel economy of 25 miles-per-gallon. The District Court issued a preliminary injunction on the basis that the regulation was preemption by the Energy Policy and Conservation Act (EPCA), which is the exclusive federal regulator of fuel economy.
