First District Court Finds Challenge to City’s Housing Element Barred by Statute of Limitations
Urban Habitat Program v. City of Pleasanton, ___Cal.App.4th___
On July 22, 2008, the First District Court of Appeal reversed a judgment of dismissal from the lower court in part, holding that claims against a city’s affordable housing regulatory compliance did not challenge an “action taken” and thus were not subject to the restrictive limitations periods that apply to claims challenging local land use decisions.
