This month, News from the West looks at recent water decisions and negotiations in California, Colorado, and Oregon. The first analyzes whether and in what circumstances prescriptive water rights can exist between private parties in California. The second involves a confined aquifer and the validity of Colorado’s new rules prohibiting certain withdrawals in the aquifer that cause water levels to fall below defined historic levels. The third involves proposed settlement agreements that could end several years of litigation between Indian tribes, fishermen, the federal government, and water users in Oregon over the propriety of biological opinions governing federal operations on the Columbia and Snake Rivers.
