  • Third District Court Allows Low-Income Housing Landlord to Pursue Contract Action against California Department of Housing

    300 DeHaro Street Investors v. California Department of Housing and Community Development, ___Cal.App.4th___

    The Third District Court of Appeal held that a landlord operating low and very low-income rental housing could pursue a breach of contract action against the California Department of Housing and Community Development where the department denied the landlord’s application to raise rents. Unlike the trial court, the Court of Appeal found that the landlord’s exclusive remedy was not a mandamus action.
