Metropolitan’s New Water Supply Allocation Plan Gets Challenged Immediately
On April 16, 2008, the Central Basin Municipal Water District (Central Basin) filed a petition for writ of mandate and complaint (petition) challenging the controversial “Water Supply Allocation Plan” (Met. Allocation Plan) adopted barely two months earlier by the Metropolitan Water District of Southern California (Metropolitan). Central Basin’s challenge asserts a wide variety of claims based on alleged violations of state statute and the U.S. and California Constitutions, most of which relate back in some way to Central Basin’s general accusation that the Met. Allocation Plan “robs from the poor to pay the cost of new development in more affluent areas.”
