District Court Dismisses Claims Regarding Contamination of Amazonian River Basin in Peru Due to Forum Non Conveniens
Carijiano et al. v. Occidental Petroleum Corp. et al., ___F.Supp.2d___
After a California environmental rights group filed suit in U.S. District Court in California for environmental contamination allegedly caused by defendants in Peru, the District Court for the Central District of California granted the defendant’s motion for dismissal based on forum non conveniens and denied the plaintiff’s motion to conduct limited discovery relating to the forum non conveniens issue. The court held that Peru was an adequate forum for the case to be heard and that the public and private interest factors weighed in favor of dismissal.
