This month’s News from the West reviews the water claims brought by Montana against Wyoming under the 1950 Yellowstone River Compact, which is an allocation of water rights between the states of North Dakota, Montana and Wyoming. Additionally, a California Appellate Court upheld a decision that found the California Coastal Commission has jurisdiction to unilaterally designate “environmentally sensitive habitat” and prevent development on land four and half miles from the ocean on the grounds that it would impair scenic and visual resources. Finally, the Idaho Supreme Court found that the City of Pocatello did not hold federally created water rights based on an 1888 Congressional Act.
