Ninth Circuit Affirms Guilty Verdict for Defendant Arising from Unlawful Importation of Ozone-Depleting Substance R-12 Pursuant to the Clean Air Act

The Ninth Circuit upheld the District Court’s guilty verdict against an individual who, along with his two brothers, was arrested and convicted for activities involving the sale of R-12 freon unlawfully imported from Mexico. The conviction was for a violation of customs law, 18 U.S.C. § 545, and was premised on the defendant’s violation of regulations pursuant to the federal Clean Air Act (CAA).
