Environmental Groups Challenge Approval of Coastal Development Permit for Desalination Facility in Carlsbad

On January 23, 2008, District Court Judge Oliver Wanger issued another order in Natural Resources Defense Council v. Kempthorne. The order concerns several motions to dismiss that challenged the plaintiffs’ second supplemental complaint. As discussed in greater detail below, the court issued a mixed ruling which denied certain motions and granted others on specific grounds.
