New Mexico Supreme Court Affirms Home-Rule Municipality’s Authority to Regulate Domestic Wells within City Limits

The New Mexico Supreme Court recently affirmed the New Mexico Court of Appeals’ decision that a declaratory judgment action can be used to challenge a municipality’s authority to regulate the drilling of wells within municipal boundaries, provided such action not be used to circumvent established judicial review procedures.
