First District Rejects Determination of Comparative Equity Analysis in Reviewing Consolidated Condemnation Cases
State Route 4 Bypass Authority v. Superior Court, ___Cal.App.4th___
On August 8, 2007, the First District Court of Appeal resolved an issue material to two consolidated condemnation cases brought by the State Route 4 Bypass Authority (Bypass Authority). Specifically, the court found that the trial court erred in finding a dedication requirement constitutionally invalid, and directed issuance of a peremptory writ essentially overturning the trial court’s decision in full.
