First District Court Finds Allegations Sufficient to State a Claim for Violation of the Brown Act against City and City Council of Fremont
Wolfe v. City of Fremont
On October 31, 2006, the First District Court of Appeal affirmed a dismissal of certain claims against the City of Fremont’s city manager and chief of police, and reversed the trial court on claims made against the city and city council. Specifically, the court found that plaintiff J. Dennis Wolfe (Wolfe) had failed to state a claim that the city manager and chief of police had violated the Brown Act, but had stated a claim that such a violation had occurred with respect to the city and Fremont City Council.
