News from the West—Protecting Salmon
Salmon Spawning & Recovery Alliance v. Gutierrez, ___F.Supp.2d___

This month three cases are examined, each of which involve the protection of salmon. In the first case, the plaintiffs unsuccessfully sought to use the Endangered Species Act to protect the threatened salmon from the action of foreign parties. In the second case, the court threatens government agencies with liability provisions of the ESA unless a satisfactory plan to protect the salmon is devised. Finally, in the third case, an historic settlement agreement looks to restore a river channel and reinstate salmon to their once native habitat.
