First District Holds Trail Immunity under California Government Code Applies to Claims Arising from Design and Location of Trail

On October 6, 2006, the First District Court of Appeal affirmed a lower court’s ruling granting summary judgment for the defendant City of Piedmont (city) on the basis of statutory “trail immunity.” The court confirmed that the paved pathway in question constitutes a trail under the relevant statute, and further, that trail immunity also covers claims arising from a trail’s design and location, as well as maintenance.
