  • California Water Resources Control Board Issues Proposed Rule Concerning Grants of Stay of the Effect of a Regional Water Quality Control Board

    The California State Water Resources Control Board (State Board) has issued proposed rulemaking regarding the grant of a stay of the effect of a regional water quality control board action under Water Code § 13321. Previously a stay of a regional water quality control board action required that a hearing be held prior to the issuance of a stay. Water Code § 13321 was amended to require a hearing on a stay only upon request. The proposed amendment to California Code of regulations, title 23, § 2053, will reflect the change. The written comment period closes on November 27, 2006.
