First District Finds Abuse of Discretion, Violations of CEQA in Agency’s Approval of Timber Harvest Plan Modified During Public Comment Period

On August 30, 2006, the First District Court of Appeal affirmed the judgment of the Superior Court issuing a peremptory writ of mandate compelling the California Department of Forestry and Fire Protection (CDF) to rescind its approval of Timber Harvest Plan 219 (THP 219), but otherwise remanded to the trial court with instructions to modify its order in two respects.
