Utah Supreme Court Reinforces Contractual Nature of Non-Profit Mutual Water Companies
Dansie v. City of Herriman
The Utah Supreme Court in Dansie v. City of Herriman, 2006 UT 23, April 18, 2006, reinforced the contractual nature of articles of incorporation and other core documents of non-profit mutual water companies in rejecting a claim of certain shareholders that their stock ownership in the company gave them an actual ownership interest in the water rights and distribution facilities of the water company.
