Colorado Supreme Court Revisits the Distinction Between Contractual Water Delivery Rights and Adjudicated Water Rights
Public Service Company of Colorado v. Meadow Island Ditch Company No. 2
In this case, the Colorado Supreme Court reconsidered the distinction between contractual water delivery rights and decreed water rights. Public Service Company of Colorado (PSCo) is a successor to two agreements that provided it an interest in contractual delivery rights and adjudicated water rights. PSCo filed an application in the Division 1 Water Court to change such rights and involve them in a plan for augmentation.
