Settling with Certainty—California Courts of Appeal Grapple with Challenges to the Settlement of Land Use Litigation
As many land use practitioners can attest, litigation of land use disputes is, in many respects, a waste of resources and questionable use of the various land use and environmental laws that comprise the practice area. With the underlying concern in most land use litigation being whether or not particular property should be developed in a certain manner, and not necessarily whether the Brown Act (Gov. Code, § 54950 et seq.), or the Subdivision Map Act (Gov. Code, § 66410 et seq.), or the California Environmental Quality Act (Pub. Resources Code, § 21000 et seq.), or other principles of local government and land use law have been complied with, the settlement of such disputes may be the best way to achieve the underlying goals of the parties.
