‘Principal County’ LAFCO Had Exclusive Jurisdiction to Establish Sphere of Influence for a Multi-County District within the Boundaries of the Local LAFCO’s County
Placer County Local Agency Formation Commission v. Nevada County Local Agency Formation Commission
Resolving a “turf battle between neighboring Local Agency Formation Commissions (LAFCOs)” under the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 (Gov. Code, § 56000 et seq.), on January 13, 2006, the Third District Court of Appeal held that the “principal county” LAFCO had jurisdiction to establish the sphere of influence and conduct service reviews for a multi-county special district operating within the boundaries of the local LAFCO’s county. The decision means that the Nevada County LAFCO has jurisdiction to prepare both the municipal service review for sewer services within Placer County, and the sphere of influence plan for the Truckee Sanitary District (TSD) within the boundaries of Placer County.
