Fourth District Rules CEQA Does Not Apply to County Decision to Place Local Sales Tax Measure Promulgated by Local Transportation Authority on Ballot

On January 23, 2006, the Fourth District Court of Appeal granted a petition for writ of mandate filed by the San Bernardino Associated Governments (SANBAG), compelling the Superior Court of San Bernardino County to vacate its order overruling SANBAG’s demurrer and to enter a new order sustaining the demurrer without leave to amend, rejecting the claim of real parties in interest Sierra Club and Allen Bartleman (Sierra Club) that the San Bernardino County Board of Supervisors (Board of Supervisors) was required to conduct environmental review before placing a sales tax measure on the November 4, 2004, ballot.
