Fourth District Court Finds that Letters Written by Homeowners’ Association Attorney Fall under Anti- SLAPP Statute Protection

On December 19, 2005, the Fourth District Court of Appeal reversed and remanded a trial court finding on whether two letters from the attorney for a homeowners’ association fell under the confines of Code of Civil Procedure § 425.16, the anti-SLAPP statute. Here, the Harbor View Community Association (HVCA) appealed the trial court’s denial of its special motion to strike under Code of Civil Procedure § 425.16, the anti-SLAPP statute. The HVCA brought the motion challenging a libel cause of action brought against it by Christopher Ruiz.
