First District Rules Inverse Condemnation Action Unripe, Rejects Application of Futility Exception to Ripeness Doctrine

On October 18, 2005, the First District Court of Appeal granted a petition for a writ of mandate filed by the County of Alameda, compelling the Alameda County Superior Court to grant the county’s motion for summary judgment in an inverse condemnation action brought by real party in interest San Leandro Rock Company (SLRC) and rejecting SLRC’s attempt to invoke the futility exception to the ripeness doctrine.
