Second Circuit Refuses to Accord Defense to EPA in Title V Matter

The Second Circuit Court of Appeals refused to defer to the U.S. Environmental Protection Agency’s (EPA) judgment in its refusal to grant a petition objecting to a Title V operating permit for two major stationary sources in New York. The court found the rationale behind EPA’s decision to be inconsistent with Title V of the Clean Air Act (CAA; Title V).
