On October 13, 2005, after eight years of litigation, the U.S. Court of Appeals for the Ninth Circuit affirmed the District Court’s order requiring divestiture of water systems and penalties against defendant owners and operators of various private water systems in Monterey County, California for numerous violations of the Safe Drinking Water Act (SDWA), 42 U.S.C. § 300f et seq.
