Fifth Circuit Finds Environmental Insurer Must Indemnify Insured for EPA-CERCLA Response Costs

On September 19, 2005, the Fifth Circuit Court of Appeals held that an environmental insurer must indemnify its insured, in the face of U.S. Environmental Protection Agency (EPA) initiated ation, under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA).
