Lawsuit Seeks to Invalidate Amador Water Agency Resolution Related to Amador Water Transmission Project

On July 28, 2005, owners of property adjacent to the New York Ranch Reservoir and Protect the Historic Amador Waterways (collectively, PHAW) filed suit against the Amador Water Agency (AWA). PHAW alleges that the AWA violated the California Environmental Quality Act (CEQA), the landowners’ due process rights, and a trial court writ by adopting Resolution No. 05-27 (resolution) in June 2005. According to PHAW’s complaint, the resolution directs the AWA’s General Manager to enter into an agreement to develop a plan for the reservoir’s management after the proposed Amador Water Transmission project (proposed project) is operational.
