First District Court Finds City’s Agreement with Tribe Regarding Impacts of Proposed Casino Project Not Subject to Referendum
Worthington v. City Council of the City of Rohnert Park, ___Cal.App.4th___
On June 30, 2005, the First District Court of Appeal upheld the City of Rohnert Park’s approval of an agreement with the Federated Indians of the Graton Rancheria regarding potential local impacts of the tribe’s proposed casino, 300-room hotel, spa, and entertainment resort. The court upheld the trial court’s conclusions that the approval of the agreement constituted an administrative act not subject to referendum, and that the agreement’s provisions were not inconsistent with the city’s adopted general plan.
