California Supreme Court Rules Coastal Commission Is Constitutional
Marine Forests Society v. California Coastal Commission, ___Cal.4th___
On June 23, 2005, the California Supreme Court unanimously reversed a Court of Appeal’s decision that had found the California Coastal Commission (Coastal Commission) to be in violation of the separation of powers doctrine under the California Constitution. The Court concluded that regardless of the previous structure, the legislature’s 2003 special legislation had sufficiently reduced the ability of the legislature to influence the Coastal Commission.
