  • Court of Appeal Confirms Attorneys Fee Award for Initiating Action that Lead to Positive Impact on Public Interest

    Protect Our Water v. County of Merced, ___Cal. App.4th___

    On May 25, 2005, the Fifth District Court of Appeal, in an unpublished opinion, reversed a superior court order denying attorneys fees for Protect Our Water (POW). In 2001 POW filed an action in Merced County Superior Court challenging the County of Merced’s approval of a surface mining project and the attendant Environmental Impact Report (EIR).
