  • Sacramento County Superior Court Upholds Narrative-Based General Stormwater Permit Associated With Construction Activity

    San Francisco Baykeeper, et al. v. California State Water Resources Control Board

    On May 18, 2005, Sacramento County Superior Court Judge Lloyd G. Connelly upheld the General Permit for Stormwater Discharges Associated with Construction Activity (General Permit) and the accompanying fact sheet on sampling and analysis. The ruling rejects arguments that the General Permit must include numeric rather than narrative limits and emphasizes the scientific and technical difficulties of relying on stormwater samples from construction run-off to measure actual compliance with state water quality standards.
