District Court Dismisses Insurers Claims against Federal Government on Lack of Subject Matter Jurisdiction
American Int’l Specialty Lines Insurance Co. v. U.S., ___F.Supp.2d___
The U.S. District Court for the Northern District of California dismissed an insurer’s indemnification and subrogation claims against the United States and the U.S. Department of Navy for soil cleanup. Specifically the indemnification claims were under the exclusive jurisdiction of the Federal Claims Court and the CERCLA claims were not yet ripe.
