  • District Court Remands to State Court a Negligence Per Se Claim Premised on Violation of the Federal Safe Drinking Water Act

    Harding-Wright v. District of Columbia Water and Sewer Authority, ___F.Supp.2d___

    The U.S. District Court for the District of Columbia has ruled that federal court jurisdiction does not exist on a claim of negligence per se premised upon violations of the federal Safe Drinking Water Act (SDWA). The court ruled that the negligence per se claim is merely an alternative to the negligence claim, and therefore will not support jurisdiction in federal court.
