  • First District Court Interprets Local Agencies’ Authority to Grant Extensions of Tentative Maps under Govt. Code § 66452.6 after Maps Have Expired

    Bodega Bay Concerned Citizens v. County of Sonoma, ___Cal.App.4th___

    On January 14, 2005, the Court of Appeal for the First Appellate District reversed the trial court’s judgment and peremptory writ of mandate directing the County of Sonoma to set aside its decision extending the expiration date of a tentative subdivision map for a residential housing project. The Court of Appeal held that Government Code § 66452.6 authorized the county to act on Bodega Bay Sunset Property’s (Sunset) application even after the tentative map expired.
