District Court in New York Holds Citzen’s Group Cannot Sue United States to Prevent Mosquito Spraying.

The District Court of New York (Western District) recently rejected a citizen’s group’s argument and held that the U.S. Environmental Protection Agency (EPA) could not be sued because it had the “discretion” to approve or reject New York’s Clean Water Act (CWA) Program.
