On September 24, 2004, the Ninth Circuit af-firmed the District Court’s decision that the Association of California Water Agencies (ACWA) was entitled to attorneys’ fees and costs under the federal Endangered Species Act (ESA) after the result of other related litigation rendered ACWA’s case moot.
