  • Fifth Circuit Upholds Jury Award for Breach of Duty to Defend under Pollution Endorsement-Based Insurance Policies

Primrose Operating Co., Cada Operating, Inc. v. National American Insurance Co., ___ F.3d ___

The United States Court of Appeals for the Fifth Circuit affirmed a District Court’s post-trial rulings upholding a jury’s award of damages for breach of duty to defend. The Fifth Circuit reversed the District Court’s post-trial ruling on calculation of prejudgment interest, however, and partially remanded the case for recalculation.
