ARIZONA: Enforcement of Water Quality Regulation and Penalties

In recent years, Arizona has revamped its approach to compliance and enforcement of state environmental quality laws and regulations, including those pertaining to water quality. The Arizona Department of Environmental Quality (ADEQ), the agency with primary responsibility for water quality regulation in Arizona, is shifting its focus in an effort to streamline enforcement and compliance assistance and apply the law and rules as consistently as possible. Years of work toward these goals have produced comprehensive guidance in the form of the ADEQ Compliance and Enforcement Handbook, which provides specific information including forms, boilerplate and other guidance for state and delegated regulators responsible for enforcing Arizona water quality and other environmental laws. Increasingly asked to do more with fewer resources, the agency continues to streamline, to accomplish consistency in pursuing and escalating enforcement while retaining enforcement discretion.
