District Court Holds Duty to Defend and Indemnify in Case of Suit Arises only after a Lawsuit Is Filed in a Court of Law.
American Motorists Insurance Company v. Stewart Warner Corporation,___F.Supp.2d___
In this case, the U.S. District Court for the Northern District of Illinois found that since the insured had not had a complaint for environmental contamination filed against it in a court of law, an insurance company was not obligated to defend and indemnify.
