Ninth Circuit Holds Environmental Consultant’s Documents Protected From Disclosure to Grand Jury Investigation under the Work Product Doctrine

The Ninth Circuit Court of Appeals recently upheld the right of a environmental consultant to withhold disclosure of documents prepared for its counsel in anticipation of litigation, even where the same documents may have been prepared in substantially similar form despite the pending litigation.
