District Court in Illinois Certifies Pollution Case as Class Action
Ludwig v. Pilkington North America, Inc.
The United States District Court for the Northern District of Illinois recently certified as a class action a case filed by all residents of a town alleging that a former manufacturing facility had caused damage to property throughout the town as a result of alleged improper disposal of arsenic waste. The court concluded that the requirements for class certification under Federal Rule of Civil Procedure 23 had been satisfied.
