Colorado Supreme Court Expands on Legal Requirements for Water Rights Abandonment
East Twin Lakes Ditches and Water Works, Inc. v. Board of County Commissioners of Lake County
In this case, the Colorado Supreme Court revisited the legal requirements for water rights abandonment. East Twin Lakes Ditches and Water Works, Inc. (East Twin Lakes), the owner of a junior water right, brought a declaratory judgment action seeking a determination that Lake County and its predecessor had abandoned their senior water right for the Derry Ditch No. 1.
