California Court of Appeal Decides Regional Boards Need Not Consider Economic Burdens when Determining Permit Effluent Limitations

The Second Appellate District Court in Los Angeles faced the issue of the whether regional water quality control boards must account for potential economic burdens on dischargers when the Boards set effluent limitations in wastewater discharge permits. The consolidated cases, City of Burbank v. California State Water Resources Control Bd., Case no. B150912, and City of Los Angeles v. California State Water Resources Control Bd., dealt with discharge permits issued by the California Regional Water Quality Control Board for the Los Angeles Region (Regional Board) for treatment works in Burbank and Los Angeles.
